Medication
People using mental health services have the right to refuse, or accept, medication, unless they are detained under the Mental Health Act 1983.
If a patient is detained for assessment or for treatment, medication can be given without consent. However, this must be done as part of a treatment plan and any decision to give medication without consent must consider the proportionality of the patient’s situation. Wherever possible, patients should be fully involved in decision-making.
People detained in hospital can access support from an Independent Mental Health Advocate who can provide further information and support to patients so that they can get involved in decisions about their treatment.
